Santa Clara University Law School Speakers Panel

On Monday, February 8, 2010 there will be a panel of speakers at the Santa Clara University Law School to discuss proper regulation of medical cannabis in San Jose. The event is open to the public and I think it will be beneficial if you are able to attend. Also, if you are a San Jose resident, please send an email to your local Councilperson asking that they attend this event, as it will provide them good information on the benefits of a well-drafted, well-intentioned ordinance for medical cannabis.
The speakers for this event will be:
Larry Kessler. Mr. Kessler works for the San Francisco Department of Public Health and is the Medical Cannabis Dispensary Program Manager for San Francisco. San Francisco has 23 permitted dispensaries. Mr. Kessler will be discussing his experiences with administering the City’s complex regulatory scheme.
Gerald Uelmen. Mr. Uelmen is a Professor of Law and the Director of the Heafey Center for Trial and Appellate Advocacy at Santa Clara University School of Law. He was lead counsel in People v. Kelly, a challenge to the limits on the amount of cannabis patients or caregivers may possess. Professor Uelmen argued the Kelly case before the California Supreme Court in November 2009, and the Court came out with a unanimous decision in favor of Mr. Uelmen. In addition to being former Dean of the Law School, Professor Uelmen is known as one of California’s leading criminal defense specialists and has been recognized by the California Lawyer magazine as one of the top criminal defense lawyers in the state. He has served as president of the California Attorneys for Criminal Justice, the California Academy of Appellate Lawyers, and the Santa Clara County Bar Association. His distinguished appellate career includes numerous arguments in state and federal courts, including the California Supreme Court and the United States Supreme Court.
Matthew Kumin. Mr. Kumin, a long-time practitioner of civil rights law in both state and federal courts, has advised patients, caregivers, patients’ cooperatives, governmental agencies, and legislative bodies regarding medical cannabis issues since 1996. He was lead counsel in the first United States Tax Court case that addressed the federal income taxation of medical cannabis CHAMP v. Com’r of the IRS, 128 T.C. No. 14 (May, 2007). He is a former president of the California Association of Cooperatives, and has formed over 50 patient cooperatives statewide. His other medical cannabis legal work includes: litigation involving the rights of disabled patients in Sonoma County and the City of Vallejo; consulting with attorneys statewide on the development of equal protection cases on behalf of patients. He speaks nationally on various legal issues concerning medical cannabis, including defending against federal trafficking charges under the Religious Freedom Restoration Act. Mr. Kumin has also taught classes at several Bay Area law schools, including Santa Clara, Hastings and Golden Gate University.
